1158pm’s servers provide web hosting and dedicated web hosting to many clients and has a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure that these obligations are met.

All customers and users of 1158pm services and/ or online facilities must comply with these Policies and Terms of Service at all times. Failure to comply with these Policies and Terms of Use may result in suspension or termination of services or other actions by 1158pm.com.

Content:
All services provided by 1158pm may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene or material protected by trade secret or other statute. The subscriber agrees to indemnify and hold harmless 1158pm from any claims resulting from the use of the service that damages the subscriber or any other party.

All pornographic content and sex-related merchandising is prohibited on all 1158pm servers. This includes sites that may infer sexual content or links to adult content elsewhere. 1158pm will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to 1158pm servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Warez sites

1158pm staff will be the sole arbiter as to what constitutes a violation of this provision.

Commercial Advertising:
E-mail Spamming, sale of spam software, providing access for spam, or the sending of unsolicited e-mail, from a 1158pm server or using an e-mail address or domain that is maintained on an 1158pm machine as reference is STRICTLY prohibited.

1158pm staff will be the sole arbiter as to what constitutes a violation of this provision.

IRC:
IRC or IRC bots may not be operated on our servers at this time.

Server Abuse:
Any attempt to undermine or cause harm to a server or customer of 1158pm is strictly prohibited.

Refusal of Service:
We reserve the right to refuse, cancel or suspend service at our sole discretion.

All Sub-Networks, distributive hosting sites and dedicated servers of 1158pm must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation.

Security:
You must promptly notify 1158pm of any breach of security related to your Services, including but not limited to unauthorized use of your password or account.

Support Guarantee:
1158pm.com guarantees that clients will receive a human generated response to new legitimate support requests within 24 hours. Failure to meet this guarantee will warrant 1 day’s credit on the affected server(s) to the client’s account.

Network Uptime Guarantee:
The 1158pm.com upstream providers guarantee that our network will be available at least 99.9% of any full month. If that goal is not met, 1158pm.com will pass 100% of the credit from the upstream providers to its clients in a pro-rated fashion.

Refunds and Cancellations:
Refunds for web hosting account renewals will be granted to customers requesting a cancellation of their service no later than 10 days after the renewal date. No exceptions will be made to this policy.

Refunds will be processed and mailed within 5 business days of the cancellation date and will be made using the same method of payment as the original (refund by check or refund via PayPal and/ or credit card).

Please be advised that the cancellation of an account does not release you from financial responsibility. If your account has a past due balance and you are not eligible for a refund, the 1158pm.com Accounting department will continue collection efforts.

Terms of Service Disclaimer:
1158pm.com reserves the right to modify our terms of use agreement at any time, effective upon posting of the modified agreement on this page.

Clients are responsible to read this document from time to time to ensure that their use of the service remains in compliance with this agreement.

Continued use of 1158pm services and online facilities following any such changes shall constitute the User’s acceptance of such changes.
